Educational Rights for Foster and Homeless Youth
In accordance with California Education Code sections 48853, 48853.5, 49069.5, 51225.1, and 51225.2, and the federal McKinney-Vento Homeless Assistance Act, AEA is committed to ensuring that all students, including those in foster care and those experiencing homelessness, have equal access to educational opportunities.
Educational Rights of Foster Youth:
Students in foster care have the right to:

Remain in their school of origin, even if their placement changes, if it is in their best interest.

Immediate enrollment in a new school without delay, even if they lack typically required documents (e.g., immunization records, proof of residence).

Access to partial credit for coursework completed at prior schools.

Graduate under the state minimum requirements if they transfer schools after their second year of high school and cannot meet the local graduation requirements.

Access to educational resources and support services, including tutoring and counseling.
Educational Rights of Homeless Youth:
Students experiencing homelessness have the right to:

Immediate enrollment in school without proof of residency, immunizations, school records, or other documents.

Attend either the school of origin or the local school where they are currently living, based on the student’s best interest.

Transportation to and from the school of origin, if requested and feasible.

Access to the same programs and services available to other students, including special education, gifted and talented programs, vocational education, and school nutrition programs.

Dispute resolution processes if enrollment or school selection is denied.
Definitions:

Foster Youth: Children and youth who have been removed from their homes due to abuse or neglect and are under the care of the child welfare system.

Homeless Youth: Children and youth who lack a fixed, regular, and adequate nighttime residence, including those living in shelters, motels, cars, or temporarily doubled up with others due to loss of housing or economic hardship.
Support and Resources:
AEA has designated liaisons to assist foster and homeless youth.

The liaison is available to support students and families in accessing educational services and resolving any issues that may arise.
