Annual Notice of Parent Rights – Special Education (IDEA)
In accordance with the Individuals with Disabilities Education Act (IDEA)

Dear Parent or Guardian,

As part of our commitment to supporting every learner, AEA is obligated under the Individuals with Disabilities Education Act (IDEA) to provide you with notice of your rights and protections under federal and state law. These rights are called Procedural Safeguards, and they ensure that you can participate meaningfully in decisions related to your child’s education.

You have the right to receive this notice:

  • At least once per year;

  • Upon initial referral or your request for evaluation;

  • Upon the first filing of a state complaint or due process hearing;

  • Upon disciplinary action that constitutes a change of placement;

  • Or at your request.

These safeguards include, but are not limited to:

  • The right to request a free and appropriate public education (FAPE) in the least restrictive environment;

  • The right to participate in your child’s Individualized Education Program (IEP) process;

  • The right to give or withhold consent for evaluations and services;

  • The right to resolve disagreements through mediation, due process, or state complaints;

  • The right to access your child’s educational records.

 

AEA Annual Notice of Rights Under Section 504

Annual Notice of Non-Discrimination and Rights for Students with Disabilities – Section 504 of the Rehabilitation Act

Dear Parent or Guardian,

AEA is committed to ensuring equal educational opportunity for all students, including those with disabilities. In accordance with Section 504 of the Rehabilitation Act of 1973, no student shall be excluded from participation in, denied the benefits of, or subjected to discrimination under any school program or activity based on disability.

AEA identifies, evaluates, and provides appropriate services to students who meet the eligibility criteria under Section 504. Students who qualify are provided with a Section 504 Accommodation Plan to ensure they can access and benefit from their education.

As a parent or guardian, you have the right to:

  • Request an evaluation to determine your child’s eligibility under Section 504;

  • Participate in any meetings concerning your child’s identification, evaluation, and educational placement;

  • Receive prior notice before the school initiates or changes your child’s 504 plan;

  • Examine relevant educational records;

  • File a grievance or request an impartial hearing if you disagree with decisions made regarding your child;

  • File a complaint with the U.S. Department of Education, Office for Civil Rights (OCR).
